What is a Minor Variance?
A Minor Variance allows a property to have a small change from the requirements of the zoning by-law, usually in order to receive a building permit. It is also required to expand or change a use that is considered Legal Non-Conforming (LNCU),
Obtaining a Minor Variance does not change the property's allocated zoning.
In some instances, external agencies and other city departments may require certain conditions be met prior to the approval of a Minor Variance.
Depending on the city or town, a sign must be posted on the property with the proposed building activities and future plans of the property. This is required for approximately 30 days, and then a public hearing is held in which objections, if any, are heard and contested.
